Personal Injuries On HolidaySadly people are often injured on holiday. This may be due to food poisoning or faulty materials in your accommodation, a poorly maintained hire vehicle, or equipment for diving, etc and many other causes. Sometimes, these claims need to be made through the legal system in the country where you were on holiday but, assuming you had holiday insurance, they can often be made in the UK. Example: Injury Claim After Camping HolidayMr & Mrs A went on holiday to France and where staying on a campsite in a tent. They were having a great time and had enjoyed very hot and sunny weather every day. On the 8th day of their holiday, they were preparing their lunch and had lit the gas stove and where boiling a saucepan of water. Mr A picked op the boiling pan and was moving it to the preparation are when without warning, the handle of the saucepan gave way and split at the joint. He had the handle in his hand and the pan fell to the ground, splashing Mr & Mrs A with boiling hot water. Both were stood close and, unfortunately suffered third degree burns to their legs and bare feet. They both were taken to the local hospital and could not enjoy the remaining 6 days of their holiday. They also had to have assistance packing their personal items and returning back to England. A claim was later made against the holiday company who owned the tent and equipment. They were a British company who hired a section of the French campsite. Their holiday insurance covered all the medical treatment costs but a solicitor claimed for the injury compensation. Example: Faulty Vehicle Lead To Successful Public Liability ClaimMiss B and her friend went on holiday to South Africa. Whilst there, they decided to hire an off road vehicle for a week and on one particular day, they went off exploring down a rough track. Once at the top of a steep hill, they stopped to admire the wonderful view. After about half an hour, they climbed back into the 4x4 and began their descent when suddenly, Miss B noticed the brakes where not gripping properly. The vehicle could not be slowed down and she tried to control it but, after hitting a rut, bounced off the road and through a wooded area before hitting a large rock, bringing the truck to an immediate stop. Miss B and her friend had their seatbelts on so where not thrown from the vehicle but they both suffered concussion, severe bruising to ribs and Miss B was knocked unconscious when her head struck the steering wheel. An enquiry later revealed that the off road vehicle had not been maintained to a satisfactory condition and that faulty brake pipes had led to fluid getting onto the disks, causing the brakes to lose grip. The hire company had public liability insurance and a successful claim was made against them once the two had returned to the UK.
