Defective Goods Injury

If you buy an item and it malfunctions, causing personal injury, you may be able to make a personal injury claim. Examples of this might be a product that breaks whilst you are using it. A chair that collapses for instance. Provided it can be proved that you were not at fault (misuse of the goods), a personal injury claim can be made. Example: Defective Chair Causing Injury

Mr A worked from home and had just ordered a new home office desk and chair which were delivered by courier. He assembled the desk and the chair exactly as detailed in the instructions and was soon working in his office. After about a week, he entered the office one morning, sat on the chair and after a couple of minutes of working, he suddenly fell sideways, banging the temple of his head on the corner of the desk, then crashed to the floor, landing awkwardly on his hip.

He was in severe pain and unable to get up for about an hour due to the ache from his hip and back. He was alone in the house so had to struggle to the telephone to raise help. Whist waiting for help to arrive, he noticed the seat of the chair had split down the middle and had collapsed on one side. Having sought legal advice, he was advised that clearly the chair had been poorly manufactured and the goods were not up to the task. A claim was successfully made against the supplier of the goods who, in turn made a claim against the manufacturer.

Example: Electric Shock Lead To Injury Claim

Mrs B was making a cup of tea and decided to have a piece of toast to go with it. She had recently purchased a new toaster and had been using it for around two months without problem. On this day, she put the toast in and pressed the lever when there was a loud bang and she was thrown across the floor and into the oven door. She suffered cuts, bruises and concussion and had received a nasty electric shock. She had also received minor burns to her hand. It was later established that the toaster had a design fault and that the model had been recalled but Mrs B had not received any recall notice and was unaware of the defect. She was able to take action against the manufacturer for the injuries and distress she had suffered as a result of the accident.
