Example: Serious Assault Lead To Criminal Injury Claim

Mr A was walking down a quite side road and was on his mobile phone, talking to his girlfriend. Two men where following him and as he turned a corner, they ran up to him, grabbed the phone from his hand and punched him in the face as he turned towards them. He fell to the ground and suffered a broken nose, fractured skull, and dislocated arm and shoulder. Fortunately, the incident was witnessed from a window of a cottage and the owner came out to assist Mr A and to phone the police. She was able to recall a reasonable amount of detail about the two men and they where apprehended about a week later when one of them tried to sell the mobile phone. The police where able to prosecute the men and a claim was made for the injuries that Mr A received.

Example: Damaged Arm Compensated After 2½ Years

Miss B was in a nightclub one Saturday night and was enjoying a few drinks with friends. It was about 1:00am when she went off to but a round of drinks at the bar. She heard shouting and turned to see several men fighting. Another man pulled a knife from his jacket pocket and before he could use it on one of the men fighting, he inadvertently, swung his arm back and inflicted a long cut across Miss B’s left arm. The cut was deep and cut through a tendon in her arm as well as causing the loss of quite a lot of blood.

The club called the police and all men where arrested at the scene. Miss B was taken by ambulance to the hospital and was kept in for several days. She received surgery to her arm but only regained around 50% of strength and mobility in it. After two years, it was determined that she was likely to have a permanent reduced functionality of the arm. Fortunately, several weeks after the accident occurred, Miss B was advised to make a claim for compensation. Having received legal advice, she was able to claim and the claim was concluded after two and a half years from the date of the injury.
