Compensation Guarantee
Although we guarantee that almost all our clients will receive 100% of their compensation if their claim
is successful, there are some occasions when this is simply not possible. Below are explanations of these
exceptions.
Criminal Injury and MIB Untraced Driver Claims
If you have been injured as a result of a criminal attack or you have been injured my a motorist who leaves
the accident scene and no details about them were obtained, then we can still find you a solicitor who will
deal with your claim. Solicitors are entitled to legal costs and these are usually paid by a third party insurer,
however, that is not possible in these types of cases. The costs the solicitor is entitled to are set very low
and it is therefore necessary for an additional charge to be made for the work they carry out on your behalf.
The amount of this charge will vary and is unlikely to exceed 25% of the value of your claim. All charges would
be fully explained to you in detail by the solicitor before the matter was taken any further.
Claims That Are Almost 3 Years Old
There is a 3 year time limit for making a claim for injury compensation. After that time, if a claim has not
been started, you lose your right to make a claim. However, to prepare a claim and to attempt negotiation, a
solicitor would usually require a minimum of 3 to 6 months. If the claim is started with less than this amount
of time left, it will usually be necessary for the solicitor to issue legal proceedings to protect the client’s
legal position ( once this is done, there is more time available ). This requires a considerable amount of work
by the solicitor as well as the cost of issuing proceedings in the court. On these occasions, a solicitor may
require a payment up front to cover those costs, or may charge a fee at a later stage. All charges would be
fully explained to you in detail by the solicitor before the matter was taken any further.
Claims With A Very High Degree Of RiskWhen our solicitors obtain information from you about your claim, they will assess the likelihood of you case being won. If there is an unreasonably high chance of your case losing, they will advise you of the risk and suggest that you do not pursue a claim. Of course, you have the choice to pursue a claim if you still wish to do so, however, you would need to fund such a case.
