The solicitor
Injury Claims Solutions (ICS) need a specialist panel of highly skilled, proactive solicitors who will fight hard on behalf of claimants and who believe that winning the case is more important than maximising costs.
Our promise to the claimant
We promise the claimant that they will not be charged for any service they receive from our panel solicitors or from ICS. This includes any shortfall on solicitor’s costs, any disbursements, ATE insurance policy costs, or any other costs directly or indirectly associated with the handling of the claim.
Of course, there are always exceptions and if there is a chance that the claimant will possibly become liable for costs, this must be made very clear to the claimant from the outset and confirmed in writing.
The membership fee
The cost of joining the ICS panel is fixed at £600 per month net of VAT (£705 inc VAT), The first payment is made by cheque to Injury Claims Solutions followed by payments by Direct Debit. You agree to become a member of the panel for a minimum of 3 months.
This Invoice/ notification is for information purposes only. The amount due will be collected by Direct Debit on or immediately after the 22nd of the following month.
The process
ICS will supply leads via email and asks that the solicitor contacts the claimant by telephone or email within 24 hours of receipt. The panel solicitor must assess the lead and discuss with the claimant as soon as possible and then make a decision to progress matters or reject the lead. If the lead is rejected, please ensure you notify the claimant that you will not be dealing with their claim, giving them the reason/s why, and then return the lead to ICS via email, with an explanation for rejection. ICS will either dispose of the lead or reallocate it to another panel member, depending on the reason for rejection. ICS often have cases returned by one solicitor but accepted by another for a whole range of reasons.
General
ICS is a marketing business and will invest heavily in a number of marketing methods in order to try to generate a volume of leads for its panel members. The leads generated will be allocated to the panel solicitors on a rotational basis. ICS will endeavour to take steps to maximise both the quality and quantity of the leads supplied to it’s panel members by actively exploring all marketing methods. Please note that, as with any marketing activity, results are not guaranteed as there are factors beyond our control. All panel membership fees paid to Injury Claims Solutions are not refundable under any circumstances, however, if cancellation of membership by the panel solicitor takes place, we will continue to supply leads to the panel member for a further 30 day period immediately after cancellation, in an effort to try to ensure the panel member is not financially out of pocket.
Cancellation
Either ICS or the panel member has the right to terminate this agreement for the following reasons.
1) The solicitor is unhappy with the service level. The solicitor must firstly contact ICS by telephone or in writing to advise ICS of the reason’s they are not satisfied. ICS will investigate and respond to the solicitor within 48 hours. If the solicitor is unhappy with the outcome they must give 30 day’s notice in writing of their intent to leave the panel.
2) ICS is unhappy with the solicitor’s service. ICS will contact the solicitor by telephone or in writing to advise the solicitor of the reason/s they are not satisfied. The solicitor must investigate and respond to ICS within 48 hours. If ICS is unhappy with the outcome, they must give the solicitor 30 day’s notice in writing of their intent to remove them from the panel.
3) Payment of the monthly membership fee ceases. ICS will contact the solicitor to establish the reason/s for the payment ceasing. If the problem can be rectified, the solicitor must immediately pay the outstanding sum in order to continue to receive leads from ICS beyond the 30 day period after cancellation.
Changes to the agreement
During the period of this agreement, Injury Claims Solutions may develop additional services to offer its panel members. Panel members may also decide to change the types of cases they wish to receive. Any changes requested by either party (ICS or a panel member) must be confirmed in writing and accepted by mutual agreement and in writing.
We will receive injury claim leads from Injury Claims Solutions under the following categories;
1) RTA accidents Y/N 2) Accidents at work Y/N 3) Public Liability Y/N
4) Medical Negligence Y/N 5) Criminal Injury Y/N 6) Other types Y/N
